Library Law Shorts - Executive Orders you may not know of
by Membiela, Clare (MDE) 16 Apr '20

16 Apr '20

Greetings! There are a few Executive Orders that have been issued that are of interest and importance to the library community. This update will provide a summary of these EO's and links to additional information. EO 2020-48 "Temporary authorization of remote participation in public meetings and hearings and temporary relief from monthly meeting." https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-525888--,00.html This EO rescinds EO 2020-15, which temporarily amended the Open Meetings Act to specifically permit public bodies (including public library boards) to conduct their public board meetings remotely via teleconference or videoconference. EO 2020-48 extends these amendments to May 12, 2020. Therefore, public library boards mat continue to have their public meetings remotely, via videoconference or via conference call, as long as certain requirements are met (including ensuring that the public can participate, and that proper noticing occurs). An FAQ on this EO is available https://www.michigan.gov/coronavirus/0,9753,7-406-98178_98455-525872--,00.h… EO 2020-38 Temporary extensions of certain FOIA deadlines to facilitate COVID-19 emergency response efforts https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-524359--,00.html This Executive Order temporarily amends the Michigan Freedom of Information Act (FOIA) to permit public entities that receive FOIA requests additional time for responding to FOIA requests that arrive via regular mail or fax. In addition, completion of any request (including via e-mail or text) may be extended until the expiration of the Executive Order, which is June 4, 2020. A good explanation of this EO is available from Foster Swift: https://www.fosterswift.com/communications-whitmer-temporarily-suspends-foi…<https://gcc01.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.foste…> These next two EOs are ones that have some applicability to libraries, but may have greater impact on library staff and the communities libraries serve. EO 2020-47- Temporary extension of the validity of certain driver's licenses, state identification cards, and vehicle registrations. https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-525924--,00.html This EO grants an extension of time for operator and chauffeur licenses and vehicle registrations which would be due for renewal between February 1, 2020, and May 31,2020. Drivers and owners must complete renewas online, if able https://www.michigan.gov/sos/ <https://www.michigan.gov/sos/%20> . If service cannot be completed online, and renewal occurs before June 30, 2020, there will be no late fees, and law enforcement will make no arrests or impoundments as a result of vehicle , operator, or chauffeur license expiration (which occurs between February 1, 2020 & May 31, 2020). In other words, if your license, your car (or bookmobile) registration expires between February 1 2020 & May 31, 2020, you must renew online, if possible www.michigan.gov/sos/<http://www.michigan.gov/sos/> . If the service you need is not available online, or if you are unable to complete your service online, you will have until June 30, 2020 to renew with no penalty. For full details and explanation, please see https://www.michigan.gov/whitmer/0,9309,7-387-90499_90640-525673--,00.html (overview) https://www.michigan.gov/documents/sos/COVID-19-OFFICE-CLOSURE-FAQ_684644_7… (Secretary of State FAQ - very informative!) EO 2020-19 https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-522509--,00.html Temporary prohibition against entry to premises for the purpose of removing or excluding a tenant or mobile home owner from their home. This Executive Order provides protections to rental property tenants, and residents in homes with "executory contracts" such as some land contracts. Landlords and property managers and contract holders may not remove these residents from their homes unless the tenant or resident poses a "substantial risk to another person or an imminent and severe risk to property." by Brian Johnston 16 Apr '20

16 Apr '20

Hello Everyone, As at least most of us are working from home these days, if your staff have to use their personal phones to call patrons, how are you ensuring staff phone number privacy? Are you using Google Voice? Or *67? If you're doing either of these, please let me know about your experience with them. Thanks, Brian R. Join us Friday for a dialogue about the post-pandemic library
by Pam Seabolt 16 Apr '20

16 Apr '20

We invite you to join MCLS staff for the next dialogue and discussion in our weekly series of conversations around the environment we find ourselves working in right now and what opportunities might exist as we move forward. This week we continue to discuss and co-create the post-pandemic library world. The top images of the preferred post-pandemic library future from last week’s discussion are: * Libraries deemed MOST ESSENTIAL institution in the country * Places to re-connect = libraries * Serving the underserved with new vigor * Taking the library out of the building * Library saves the day with remote patron services * Great community collaborators providing convenient services and leading in safe practices * Reinventing traditional services to meet the needs of today’s worlds * Continue to remove barriers to service and keep those changes in place * Library supports “life-essential” activities Part support group, part visioning, let’s share our thoughts and ideas as we delve deeper into these images of our preferred future. Join us this week on Friday, April 17 at 11:00 EDT (10:00 am CDT) on Zoom. Please login using this link for the Virtual Dialogue<https://zoom.us/j/172695113?pwd=dnpuUVBudFR5MHZaTHl4bTN6UjZWdz09>. Join MLA and Attorney Mike Blum of Foster, Swift, Collins, & Smith PC tomorrow, Friday, April 17 from 1:00 - 2:00pm for another FREE MLA Connect Webinar! It is important to ensure that employment policies are current and fully protect the library's legal interests. Employee handbooks are essential for employers in today's litigious environment. However, there are mistakes in drafting policies that could jeopardize an employer's ability to successfully defend employment claims. We will explore phrases and terms that should never be used in employment policies, and discuss do's and don'ts of drafting an effective employee handbook. We will also discuss strategies for getting employees back to work once Gov. Whitmer's Stay Home, Stay Safe executive order expires, and how to deal with employees who resist and would prefer to collect unemployment benefits. This webinar is free to attend for MLA Members. A maximum of 100 attendees can attend the live webinar. Registration is first-come, first-served. You must be an MLA member to register. Nonmembers interested in attending are welcome to join MLA by filling out the online membership application<https://www.milibraries.org/join-or-renew#indmemtypes> or by contacting us at (517) 394-2774 or MLA(a)milibraries.org<mailto:MLA@milibraries.org>. by Joe Gross 16 Apr '20

16 Apr '20

Good Morning! While we are, of course, at a standstill on our new library project in Plainwell, I'm working on a few areas that will be new for us/me inside the building. Do any of you wonderful people have experience with adding or using VoIP in your library? Would you be willing to share your thoughts about it in comparison to analog phone systems, tips about implementation, and/or your recommendations for vendors? Please respond off-list, and I will be happy to compile responses to post for the listserv. All my best, Joe Gross Director Ransom District Library www.ransomlibrary.org<http://www.ransomlibrary.org> -- This message has been scanned by E.F.A. Project and is believed to be clean.

Sad News: Rebecca Havenstein-Coughlin
by Megan Esseltine Hathaway 15 Apr '20

15 Apr '20

Hello all, I'm writing to share some sad news from last week. Rebecca Havenstein-Coughlin, who served the Canton Public Library from its planning stages in 1980 until her retirement in late 2018, passed away on Wednesday, April 8. If you crossed paths with Rebecca during your own library career, you may remember her friendliness, optimism, and, of course, her passion for public service. Her obituary <http://www.mccabefuneralhome.com/obituaries/details/2615?fbclid=IwAR12w9PRA…> is posted on the McCabe Funeral Home site. I also wanted to share the blog post that our library has published to honor her life and career: https://www.cantonpl.org/content/rebecca-havenstein-coughlin Thank you, Megan Hathaway Canton Public Library

Procurement of supplies needed when we reopen
by Oscoda County Library 15 Apr '20

15 Apr '20

Good afternoon: As I am sure many of us are facing the same struggles regarding supplies, I reached out to my county commissioner liaison about this. I also reached out to the commissioner who is the liaison with our local health department district. Yesterday I was directed by my county commissioners to a great resource, and I wanted to share it with everyone on the list. https://www.michiganbusiness.org/covid19/ [1] There is a link for COVID-19 virtual procurement and donation assistance forms. I had to answer a few questions related to my business, and with in 24 hours I heard from a procurement specialist. Granted the vendors listed you must purchase the supplies from, but it is someplace to start once we are allowed to reopen. Stay Healthy! Amy -- Amy Knepp, Director Oscoda County Library 430 W. Eighth Street Mio, MI 48647 TEL: 989-826-3613 TAX: 989-826-5461 http://www.oscoda.lib.mi.us Links: ------ [1] https://www.michiganbusiness.org/covid19/
