Library Law Spotlight: September - Privacy Law Update 09/30/2020 11:00 AM - 12:00 PM ET Summary - This webinar will review the pending amendments to the Library Privacy Act, as well as other legal issues surrounding information and data privacy for public libraries. Description - Privacy is an important issue for libraries. In addition to privacy laws governing patron records and reading histories, libraries must grapple with data privacy, employee privacy and even privacy of a patron's reference inquiries. Overview of EO 2020-183 AND EO 2020-184 The primary effect of these new executive orders for libraries are the provisions amending restrictions on "social gatherings or organized events." The explanation for these changes is below: EO 2020-183<https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-540568--,00.html>- Safe Start (Rescission of EO 2020-176, EO 2020-180, & EO 2020-181) EO 2020-183 continues Regions 1-5, & 7 requirement that all work that can be done remotely must be done remotely. Regions 6 & 8 are not included in this requirement, but it is recommended that all work that can be done remotely should be done remotely. Athletic and sports related mask requirements from EO 2020-180 have been integrated into EO 2020-183. Amends restrictions on "social gatherings and organized events." The change of most concern to libraries is the amendments to the restrictions on "social gatherings or organized events." The requirements are separated into two categories- FIXED Seating (i.e. bolted to the floor, like theaters, some concert venues and sports venues). and NON-FIXED. The information below is for NON-FIXED SEATING, which is applicable to the vast majority of public libraries. The information for FIXED SEATING is included in the updated EO document being posted to the Library of Michigan website. NEW RESTRICTIONS: As of Oct 9, 2020, events held in library meeting or event rooms, such as group meetings, board meetings, programs, etc. that meet the definition of " organized event or social gathering" as listed in EO 2020-183 and its FAQ (https://www.michigan.gov/coronavirus/0,9753,7-406-98178_98455-540626--,00.h… ) must limit attendance to: Regions 1-5 & 7 20 people per 1000 sq. ft , or 1 person for every 50 sq. Ft. of space in the room. If your library has a 30ft x 40ft room, 30 x 40 = 1,200 sq. ft, so that would be 20 +4 or 24 people, OR 1,200 sq. Ft. / 50 = 24 people If your room is smaller, say 20ft x 15 ft,20 x 15 = 400sq.ft.. 400 / 50 = 8 Therefore that room could have 8 people. Regions 6 & 8 25 people per 1,000 sq. ft, or 1 person for every 40sq.ft. A 30ft x40ft room, 30 x 40 = 1,200 sq. Ft. 1,200 sq. Ft / 40 sq. Ft. per person = 30 people. A smaller room 20ft. x 15ft. = 400 sq. Ft., so 400 / 40 = 10 people. These occupancies would be counted towards any general occupancy limits in force for the library EO 2020-184<https://www.michigan.gov/whitmer/0,9309,7-387-90499_90705-540600--,00.html>, Safeguards to protect Michigan's workers from COVID-19 - Rescission of Executive Order 2020-175. Amends existing industry and workplace safety restrictions to include guidelines and requirements for sports venues, movie theaters, amusement and entertainment venues and gyms/exercise facilities. Under section 6 retail, changes occupancy limit of buildings with public space 50,000sq. ft. and over from 4 people for every 1,000 sq. ft to 20 people per 1,000 sq. ft.. Removes requirement from section 6 to "Limit staffing to minimum number necessary to operate." EO 2020-184 updates overall occupancy limits in section 6 (retail/libraries/museums) for buildings 50,000sq.ft or more of public space. Existing limits for buildings up to 50,000sq.ft. of public space are still in effect: Regions 1-5,& 7: Buildings less than 50,000 sq. ft. of public space = 25% occupancy Buildings with 50,000 sq. Ft. or more of public space = 20 people per sq. Ft. (this number was increased from 4 persons per 1,000 sq. ft.) Regions 6 & 8 No occupancy limit OTHER THAN meeting/gathering limit above and limiting occupancy to number of people that can occupy building with 6ft. of social distancing requirement. My Friends group is entertaining the idea of purchasing a donor tree piece of artwork for Novi Library that would encourage community members to make a donation, and the donors name would be able to be engraved on a leaf. I have seen these art pieces in various library buildings. If you have one, would you share a photo of your donor tree, company that the tree was purchased from/or artist and send me your library’s full name and address. My group is interested in doing some road trips to see the artwork to help make their decision. Reporting to the Board of Trustees and working closely with County Administration, the Library Director has administrative responsibility for Baltimore County Public Library. Hi Clare, I have been asked by one of my township supervisor's if I'd write a letter of support for her as an incumbent in the upcoming November election. She has been a supportive patron of our library, on our Friends group, helped with millage campaigns, and her children have grown up using the library for all the years that I have been director (12 years).
