More information on MDHHS Order of May 6, 2021

Greetings! In analyzing this order more closely with the MiOSHA rules, I would encourage libraries to consult their attorneys before determining masking requirements for outdoor programming involving less than 100 people. MiOSHA rule 9(3)(b) requires libraries to mandate masks for patrons - and it doesn't clearly define the extent of that requirement with regards to indoors or outdoors. https://www.michigan.gov/documents/leo/Final_MIOSHA_Rules_705164_7.pdf There are , however, legal arguments to be made in support of both continuing to require masks and for permitting patrons to go without for outdoor programming under 100 people. We are gathering additional information on this confusion and will share more as we receive it. In the meantime, I strongly recommend that libraries consult their attorneys. Most of the changes apply to outdoor events and festivals. However, there is one change that could affect libraries: Section 8: Exceptions to face mask requirements. Although a face mask is strongly encouraged even for individuals not required to wear one (except for children under the age of 2), the requirement to wear a face mask in gatherings as required by this order does not apply to individuals who: o) Are at an outdoor gathering with fewer than 100 persons, unless otherwise required to mask as an organized sport participant under Section 6(a). This language means that patrons attending outdoor programs of less than 100 people can be maskless. HOWEVER, this does not necessarily mean that library staff may go unmasked while working or managing outdoor programs. MiOSHA Rules are unchanged. Employers may be required to update their pandemic plan or re-assess employee risk with regards to employees managing outdoor programing. Outdoor gatherings must still adhere to social distancing guidelines of 6 feet of distance between participants not in the same household. It is encouraged that libraries contact their library attorney with regard to requirements of MiOSHA vs MDHHS.
