A new MDHHS Rules is not out, but existing 5/15/2021 order is compatible with the revised MiOSHA rules.

Updated emergency rules put in place

Today, Gov. Whitmer announced updates to the Michigan Occupational Safety and Health Administration (MIOSHA) emergency rules. Under an amended set of emergency rules, MIOSHA will remove the requirement that employers create a, “Policy prohibiting in-person work for employees to the extent that their work activities can feasibly be completed remotely.”

MIOSHA has also updated other aspects of the emergency rules to reflect recent guidance from the U.S. Centers for Disease Control and Prevention (CDC) and the Michigan Dept. of Health and Human Services (MDHHS), which will take effect May 24 and expire on Oct. 14.

Draft permanent MIOSHA rules withdrawn

Recently, Gov. Whitmer announced that the MIOSHA will withdraw from the permanent rulemaking process. 

The May 26 public hearing on the permanent rules has been canceled.
